Notice of intent
Before we give a statutory fine, we will send the landlord a notice of intent.
This will tell you:
- how much the penalty could be
- why we think the penalty should be given
- how you can tell us your side of the story
Your comments
If you disagree or want to explain the situation, you can send us written comments.
You have 28 days to do this from the day after you receive the notice.
We make a decision
After the 28 days are over, we will decide:
- whether to issue the penalty
- the final amount (this may be higher or lower than the amount in the first notice)
Fixing the problem or admitting the issue does not remove the penalty, but it may mean the penalty is reduced.
We send you a final notice
If we decide to issue the penalty, we will send you a final notice.
This will tell you:
- the final amount you need to pay
- why the penalty is being given
- how and when to pay
- how you can appeal
- what happens if you do not pay
