Reporting property concerns – guidance for council tenants

How to report property concerns (e.g. boundaries and trees)

Fence or boundary issues

We would not consider fencing or boundary disputes as anti-social behaviour. You may want to have a friendly word with your neighbour regarding your concerns. We’ve put together some tips to help you resolve problems with neighbours.

The majority of complaints we get about fences are that they are broken and there is a lack of privacy. It is important to note that there is no legal requirement for a fence to be put up on a boundary, therefore there are no laws to enforce someone to replace a broken or dilapidated fence. You would be within your rights to build a fence on your side of the boundary line if your neighbour declined to replace their fence, though please check regulations with regards to the height of fencing allowed before you do this as it varies depending on where the fence is.

If you do not know which fences in your garden you are responsible for as our tenant, please contact us for help: neighbourhoodhousing@centralbedfordshire.gov.uk.

We're only responsible for fences where they border communal or public land. Please report concerns of this nature to us.

Trees

We're not responsible for trees, hedges, bushes, plants or weeds growing on private land or our tenants' gardens. You should contact the owner directly to discuss the issue. If you are in disputes with your neighbour regarding trees/ bushes, please be aware you that can prune back trees and bushes that are overhanging your land to the boundary line.

Discussion with your neighbour can often resolve issues regarding overgrown bushes, we have put together some tips to help you resolve problems with neighbours in our step-by-step guide or links and information found below.

We manage trees within housing communal areas and will survey these if there are issues and carry out works if they are a danger.
