This checklist is for:

  • Prior Approval for new dwellinghouses on terrace buildings in commercial or mixed use
  • Prior Approval for new dwellinghouses on terrace buildings in use as dwellinghouses
  • Class AA – Prior Approval for new dwellinghouses on detached buildings in commercial or mixed use
  • Prior Approval for new dwellinghouses on detached buildings in use as dwelling houses

Fee

Not more than 10 dwellinghouses: £418 for each dwellinghouse.

Between 10 and 50 dwellinghouses: £451 for each dwellinghouse.

More than 50 dwellinghouses £22,309 + £135 for each dwellinghouse in excess of 50.

Maximum fee of £405,000.

Legislation
What to include with your application
  • a written description of the proposed development, which, in relation to development proposed under Class A, must include details of any dwellinghouse and other works proposed
  • a plan which is drawn to an identified scale and shows the direction of north indicating the site and showing the proposed development
  • floor plans which are drawn to an identified scale and show the direction of north indicating the dimensions and proposed use of each room, the position and dimensions of windows, doors and walls, and the existing and proposed elevations of the building
  • a written statement specifying the number of new dwellinghouses proposed by the development that is additional to the number of dwellings in the building immediately prior to the development
  • a list of all addresses of the flats within the existing block of flats
  • the developer's contact address
  • the developer's email address, if the developer is content to receive communications electronically
  • a site-specific flood risk assessment, only where the application site falls in Flood Zone 2 or Zone 3; or an area in Flood Zone 1 which has critical drainage problems and which has been notified to the LPA by the Environment Agency
  • the correct fee

Prior Approval for new dwellinghouses on detached buildings in commercial or mixed use

All of the above, plus:

  • include the height of the existing building
  • where the existing building is 18 metres or more in height provide a report from a chartered engineer or other competent professional confirming that the external wall construction of the existing building complies with paragraph B4(1) of Schedule 1 to the Building Regulations 2010 (S.I. 2010/2214) to the local planning authority

    Paragraph B4(1) provides that the external walls of the building shall adequately resist the spread of fire over the walls and from one building to another, having regard to the height, use and position of the building
  • and take into consideration the new legislation in force from 1 August 2021 – Building safety: planning gateway one
  • relevant buildings contain two or more dwellings or educational accommodation and meet the height condition (18m or more in height, or 7 or more storeys whichever is reached first).
  • “dwellings” includes flats and “educational accommodation” means residential accommodation for the use of students at boarding school or in later stages of education (see the definition in article 9A(8)) must be accompanied by a fire statement 
  • fire statements must be submitted on a form published by the Secretary of State (or a form to similar effect) (see Annex C) and contain the particulars specified or referred to in the form, which includes information about (not exhaustive list):
    • the principles, concepts and approach relating to fire safety that have been applied to each building in the development
    • the site layout
    • emergency vehicle access and water supplies for firefighting purposes what, if any, consultation has been undertaken on issues relating to the fire safety of the development; and what account has been taken of this how any policies relating to fire safety in relevant local development documents have been taken into account

The publication of a standard form for this purpose is intended to ensure consistency in the way in which information is provided, as well as ensuring information contained within a fire statement is focused on fire safety matters as they relate to land use planning.
